SPAIN · DIGITAL NOMAD · UGE REFUSALS

Refusal of a Digital Nomad residence permit in Spain is an unwelcome outcome, but it is not always the end of the process.

The reasons for the negative decision range from insufficient evidence of income and professional activity to questions about the legality of stay in Spain.

Sometimes the problem can be resolved with additional documents. In other cases, an appeal against UGE’s decision or a fresh application is needed.

We explain the main reasons for refusal, response deadlines, appeals and the possibility of applying again.

The essentials in one minute

  • Analyse UGE’s official reasons for refusal, rather than relying only on the short case-status message.
  • Among the possible causes are income, documents, qualifications and social insurance problems.
  • For an application submitted in Spain, proof of lawful presence is especially important.
  • A request for additional documents is not a refusal: respond within the stated deadline.
  • A refusal may be appealed if there is a legal basis for doing so.
  • A fresh application is possible if the requirements for a new application are met.

MAIN REASONS

Why might UGE refuse a Digital Nomad residence permit?

The decision depends on the evidence as a whole. Having suitable remote work does not mean that attaching a contract and bank statement alone is sufficient.

01

Insufficient income

The applicant has not demonstrated the required level of resources, or the documents do not convincingly establish the income source.

02

Employers’ documents

The activities of a foreign company, the length of the employment relationship or the possibility of working remotely have not been sufficiently confirmed.

03

Social insurance

The issue of applicable social security has not been resolved or the necessary evidence has not been provided.

04

Qualifications

The required education or professional experience in accordance with the terms of the programme is not confirmed.

05

Personal documents

Problems with criminal-record certificates, document validity, legalisation or translation.

06

The legality of stay

UGE considers that the applicant’s right to be in Spain at the time of the application is not sufficiently substantiated.

Important:
The circumstances listed do not mean an automatic refusal. Each case requires identifying the specific legal requirement and assessing the evidence submitted.

ENTRY INTO SPAIN

Refusal related to entry on a Schengen visa: what is the issue?

The Spanish Digital Nomad residence application procedure is available to people who are lawfully present in Spain.

Entering on a valid Schengen visa does not automatically prohibit an application, but lawful presence must be substantiated.

In practice, questions may arise from the route of entry, lack of standard passport marks or insufficient evidence provided.

What should you check before applying?

  • Validity of a visa or other residence ground.
  • Allowed number of days in the Schengen area.
  • Date and route of actual entry.
  • Evidence of presence in Spain.
  • Whether additional official evidence can be supplied if UGE requests it.

Our approach:
If proof of entry is uncertain, assess the evidence before applying rather than waiting for the issue to appear in a refusal.

REQUERIMIENTO

Is a UGE request for additional documents a refusal?

No. A request for additional documents is a separate stage of the administrative procedure.

UGE may require clarifications or documents necessary for the evaluation of the application.

Read the notification carefully, establish the response deadline and provide evidence addressing the specific questions raised.

OUR EXPERIENCE

A request on day 22 of processing

In one of our cases, UGE requested additional documents on the 22nd day of processing the application.

We prepared a timely response and supplied the documents needed to protect the applicant’s position.

The case illustrates why electronic notifications must be monitored even after the expected processing period.

Do not ignore a document request.
Even if you believe the deadline has expired, first check the procedural consequences of the notification.

ADMINISTRATIVE SILENCE

Can a refusal arrive after silencio administrativo?

Law 14/2013 provides a positive administrative silence mechanism, silencio positivo, for the relevant permits.

However, establish whether the statutory period has actually expired, whether it was suspended and whether the conditions for applying the mechanism have been met.

If positive administrative silence has legally taken effect, a later negative decision cannot be treated as an ordinary refusal issued on time.

A CASE SHARED BY COLLEAGUES

Refusal after positive administrative silence was believed to have arisen

Colleagues shared a case in which an applicant received a refusal after the expected deadline had elapsed.

UGE considered that the legality of his stay in Spain had not been confirmed.

Appeal and reapplication procedures were used to address the situation, and a favourable outcome was subsequently achieved.

Legal nuance:
If silencio positivo has actually taken legal effect, a late refusal may be unlawful. Assess it against Law 39/2015, including the restrictions on a subsequent administrative decision.

AFTER A REFUSAL

What should you do if UGE refuses a Spanish residence permit?

The first rule is to analyse the refusal before starting a new application or lodging an appeal.

1

Obtain the complete decision

Examine the reasons, legal grounds, notification date and appeal procedure.

2

Check the deadlines

Establish the applicable deadlines for available remedies and when they start running.

3

Identify the reason for refusal

Compare UGE’s findings with the submitted evidence and statutory requirements.

4

Assess your immigration status

Check whether continued presence in Spain is lawful and what consequences the refusal may have.

5

Choose a strategy

Consider an appeal, a new application or other legally available steps.

APPEALS

How can you appeal a UGE refusal?

Depending on the type of administrative decision and the procedure for appeal specified therein, administrative or judicial remedies may be applied.

One possible administrative remedy is recurso de reposición, where available for the particular decision.

For this type of challenge to a refusal, the general deadline is usually one month from the day after proper notification. Confirm the exact procedure against the decision and applicable rules.

Judicial appeal in administrative proceedings may also be available within the time limits provided by law.

Important:
Lodging an appeal does not itself always suspend the refusal’s effects. Any issue concerning continued presence in Spain must be assessed separately.

A FRESH APPLICATION

Can you apply again for Digital Nomad residence after a refusal?

In many situations a fresh application is possible if the applicant meets the programme requirements and retains a lawful basis for applying.

However, reapplying should involve more than sending the same documents again.

Identify the circumstances that led to refusal and correct the deficiencies.

What might need to be corrected?

  • Supplement the evidence of income and its origin.
  • Prepare more complete employer or customer documents.
  • Clarify social security issues.
  • Update certificates, apostilles and translations.
  • Confirm the legality of the stay and the right to a new application.

Please note:
A new application does not automatically cancel the previous refusal or restore lawful presence if that has been lost.

CHOOSING A STRATEGY

Appeal or reapply: which is preferable?

Situation What to Consider
UGE misjudged the documents submitted Appeal with legal arguments
Documents were missing but can now be prepared A fresh application, if legally available
Dispute over legality of stay Analysis of decision, migration status and available remedies
Refusal after positive administrative silence was believed to have arisen Verification of the legal effect of silence and the possibility of challenging refusal
There are grounds both for an appeal and for a new application Evaluation of parallel procedures and their compatibility

In some cases an appeal and a fresh application may proceed in parallel.

But this is not a universal solution: the content of the initial refusal, the legality of the stay, the procedural time limits and the possible impact of one proceeding on another must be taken into account.

RISK PREVENTION

How can you reduce the risk of refusal before applying?

The most effective approach is to identify potential weaknesses in the application in advance.

Check the eligibility ground

Make sure the actual work meets the requirements of Digital Nomad.

Check Income

Prepare documents to confirm not only the amount but also the source of the proceeds.

Check entry

Ensure lawful presence in Spain is supported by appropriate evidence.

Check document formalities

Ensure certificates, translations, legalisation and other document formalities meet the requirements.

OUR ASSISTANCE

How do we assist with UGE refusals?

We assess a refusal in the context of the entire application history, from entry into Spain to the documents and correspondence with UGE.

We therefore begin by analysing the complete administrative case and then determine what further action may be taken.

What are we analyzing?

  • The text of UGE’s decision and its reasons.
  • Initial package of documents.
  • Requests for additional documents and the responses submitted.
  • Deadlines and possible administrative silence.
  • The legality of being in Spain.
  • The possibility of an appeal or fresh application.

Our aim is to identify a legally sound route rather than simply repeat a procedure that has already failed.

QUESTIONS AND ANSWERS

Frequently asked questions

Is it possible to obtain a residence permit for Spain after the UGE has refused?

Yes, in certain cases, it depends on the reason for the refusal, the ability to correct the deficiencies, and the legal basis for a new application or appeal.

How much time is given to appeal?

The deadline depends on the decision and remedy. For recurso de reposición against an express decision, the general period is usually one month. Check the appeal procedure stated in the notification.

Can you re-apply immediately after the refusal?

This depends on the case, immigration status and compliance with fresh-application requirements. Refusal does not itself create a blanket prohibition on every subsequent application, but the individual circumstances must be checked.

The refusal mentioned my Schengen visa. What should I do?

First, it is necessary to determine whether the reason was the illegality of the stay or the inadequacy of its confirmation, and then to evaluate the evidence and the means of appeal against the decision.

Can a refusal be issued after silencio positivo?

A negative decision may be made in practice, but its validity requires a separate evaluation; if a positive administrative silence does indeed occur, a late refusal may be contrary to administrative law.

Can you stay in Spain after the refusal?

This depends on the current basis of the stay and the content of the decision, and the mere fact of filing a complaint does not guarantee the right to remain in the country.

Can you appeal and submit a fresh application at the same time?

In some situations, this is possible, but it is necessary to assess the compatibility of procedures, their legal effects and the current migration status.
