Which route is better for a Digital Nomad residence permit in Spain: employment under a contract with a foreign company, or independent professional activity?
Both routes are permitted under the Digital Nomad programme. However, their documentation, social security requirements and ongoing obligations can differ significantly.
We explain how an employment-based application differs from a self-employed application, what Spanish autónomo status means and which route suits different circumstances.
The essentials in one minute
- Digital Nomad allows for remote employment and independent professional activity.
- For employment, the employer must be based outside Spain.
- Independent professionals can work with foreign clients.
- Independent professional activity may include work for Spanish clients, limited to no more than 20% of total professional activity.
- Social insurance needs to be analysed separately.
- Tax treatment is not automatically determined by the means of obtaining a residence permit.
Employment and self-employment: What’s the difference?
Spain’s Law 14/2013 distinguishes between two forms of international remote work: employment and independent professional activity.
Employment
The applicant is employed by a foreign employer and carries out the work remotely from Spain.
Self-employment
The applicant provides services to foreign companies as an independent expert on the basis of a commercial or civil relationship.
Important: Having a foreign sole-trader registration does not itself determine which category UGE will apply. The actual nature of the work and contracts must be assessed.
Employment or self-employment: comparison table
| Criterion | Employment | Self-employment |
|---|---|---|
| Basis | Employment contract | Contracts with customers |
| Contracting party | Foreign employer | One or more foreign clients |
| Confirmation of relationships | At least 3 months | At least 3 months |
| Remote work | Employer’s permission | Evidence that the work can be performed remotely |
| Clients in Spain | Under this permit, employment is for foreign companies | Up to 20 per cent of total professional activity |
| Social insurance | Depends on employer and international regulations | The applicable registration and contribution regime shall be determined |
| Taxes | Depends on tax status | Depends on tax status and the nature of the income |
Neither route is universally easier. It depends on the documents the applicant can genuinely provide.
Digital Nomad through an employment contract
This option is suitable for foreign company employees who are officially employed and can perform duties remotely.
It is important for UGE to confirm not only the existence of an employment contract, but also the reality of the employment relationship, the company’s activities and the ability to work from Spain.
Which documents are usually checked?
- Employment contract with a foreign company.
- Evidence of an employment relationship lasting at least three months.
- The employer’s permission to work remotely from Spain.
- Evidence that the company has been operating for at least one year.
- Evidence of salary and its actual payment.
- Documents on applicable social insurance.
A point to note: An employer’s letter permitting work from Spain does not automatically resolve social security requirements. These must be checked separately.
Digital Nomad through self-employment or client contracts
This option is suitable for independent professionals: consultants, developers, designers, marketers and other professionals who provide services to foreign clients.
The focus is on the validation of real professional relationships with foreign companies and the ability to perform work remotely.
Contracts
Documents must confirm relations with foreign customers, their duration and the conditions for the provision of services.
Income
Sufficient funds and actual income from professional activities must be confirmed.
Customer activities
Evidence must establish that the foreign companies have genuinely been operating for the required period.
Social contributions
The applicable social insurance regime and the manner in which obligations are fulfilled need to be defined.
Do not confuse: Foreign sole-trader registration and registration as an autónomo in Spain are different legal and administrative statuses.
Do you need to register as an autónomo in Spain?
If the applicant carries out independent professional activity from Spain, their obligations to the Spanish tax authorities and social security system must be assessed separately.
In many cases this implies registration as autónomo and compliance with the requirements.
Do not assume that foreign sole-trader registration automatically becomes Spanish autónomo status, or that registration in Spain must always take place before UGE’s decision.
Practical advice:
Before applying, establish the registration procedure, when contribution obligations arise and the documents required, coordinating the immigration and accounting aspects.
Social contributions: why is this a major issue?
An employment contract or professional income alone is not enough for a Digital Nomad application. The applicable social security arrangements must also be established.
International agreements on social security, employment characteristics and employer obligations may be relevant for foreign company employees.
For independent professionals, the issue is more often related to registration in the Spanish system and payment of contributions under the respective regime.
Employment
We are checking the applicability of international regulations and the need to register a foreign employer in Spain.
Self-employment
We establish the registration procedure and how contributions must be calculated and paid under the applicable rules.
Important: Having medical insurance does not necessarily replace social security obligations. These are separate issues.
What kind of taxes does a digital nomad pay in Spain?
Tax obligations depend not only on the mode of employment, but also on tax residence, the nature of income and applicable international agreements.
The receipt of a residence permit does not automatically imply any preferential tax treatment.
In particular, the possibility of special treatment for incoming workers, often referred to as the Beckham regime, needs to be assessed individually.
Please note:
The right to a special tax regime and the right to a residence permit are governed by different rules, and there are additional restrictions and conditions for independent professionals.
Which route should you choose: employment or self-employment?
We recommend starting from the applicant’s actual working arrangements and documents, rather than assumptions about which procedure is easier.
When employment is the more suitable route
There is a valid contract of employment, a stable salary, a foreign employer, and the ability to document a remote job.
When self-employment is the more suitable route
There are real foreign customers, commercial contracts, confirmed earnings, and independent professional activities.
If the documents do not correspond to the actual nature of the work, the artificial change in the format of employment prior to submission may create additional risks.
How do we identify the right route before applying to UGE?
1
Assess your employment arrangements
We examine the actual relationship with the employer or clients.
2
Check the documents
We review contracts and evidence of company activity and income.
3
Assess social security
We establish the contribution and documentation requirements.
4
Plan the tax arrangements
If necessary, engage an accountant or tax consultant.
5
Prepare the application
We assemble the documentation for the chosen ground and UGE’s requirements.
Frequently asked questions
Can you obtain Digital Nomad residence with Russian sole-trader registration?
Russian sole-trader registration does not itself prevent an application. The applicant must demonstrate qualifying international professional activity, contracts, income and compliance with the other requirements.
Is it necessary to have multiple customers?
The law permits professional relationships with one or more foreign companies. The essential point is to demonstrate compliance with the requirements.
Is it possible to work with Spanish clients?
Independent professionals may work with Spanish companies within the limit of 20% of total professional activity. Under the employment route, this permit provides for work for foreign companies.
Do social contributions have to be paid in Spain?
This depends on the form of employment, the applicable agreements and other circumstances, and the issue must be resolved before submission.
Can you qualify for the Beckham tax regime?
Eligibility depends on meeting the tax requirements. Obtaining Digital Nomad residence does not guarantee access to that regime.
Can the format of work be changed after obtaining a residence permit?
Changes in the nature of professional activity may affect the conditions of authorization; migration, tax and social consequences must be checked before the change.
