SPAIN · SCHENGEN · DIGITAL NOMAD

Can you visit Spain on an ordinary Schengen visa and obtain Digital Nomad residence without returning to your country of citizenship?

This possibility is provided for in Spanish law, but it is important to understand that legal entry, legal stay and the right to a residence are not the same.

When preparing an application in 2026, pay particular attention to proof of presence in Spain, visa-use conditions and the documents UGE assesses.

The essentials in one minute

  • The Schengen visa C may be the basis for a lawful short-term stay in Spain.
  • Law 14/2013 allows an application for Digital Nomad residence from Spain while the applicant is lawfully present.
  • The documents are submitted electronically to the UGE.
  • Lawful presence must be demonstrated at the time of application.
  • EES changes how crossings of the Schengen external borders are recorded.
  • The visa does not in itself guarantee a positive decision on the residence permit.

LAW AND PRACTICE

Can you apply for Spanish residence while holding a Schengen visa?

Spain’s Law 14/2013 establishes a specific residence procedure for international remote workers — teletrabajadores de carácter internacional.

Applicants lawfully present in Spain may apply for the residence permit. A category C Schengen visa therefore does not itself rule out a Digital Nomad application.

Important:
The law does not establish a general rule whereby any person holding a Schengen visa is automatically entitled to a residence permit; all the requirements of the programme must be met and the legality of stay confirmed.

This is distinct from obtaining a national remote-work visa through a consulate. Residence applications through UGE and consular visa applications are different procedures.

ENTRY INTO SPAIN

What kind of Schengen visa can be used?

A Schengen category C visa is used for short-term stay. It may be issued by Spain or another Schengen State.

However, visa rules must be observed at the time of entry, including visa conditions, authorized stay and border control requirements.

01

Visa issued by Spain

When travelling to Spain, it is easier to explain how the route is consistent with the stated purpose of the visa, but the rest of the requirements remain.

02

Visa issued by another country

Entry into Spain may be legal if the Schengen rules are observed, and the route and circumstances of obtaining a visa require a separate assessment.

03

Multiple-entry visa

MULT allows re-entry within the period of validity of the visa and the authorized number of days of stay.

04

Single-entry visa

This permits one entry. After leaving the Schengen Area, it generally cannot be used to enter again.

Our approach:
Before travel, we assess the issuing country, visa validity, route, travel history and intended application date.

BORDER CONTROL

EES: how can you substantiate entry into Spain in 2026?

Entry/Exit System (EES) is a European system for registering entry and exit of third-country nationals on short-term travel.

The system electronically records external border crossings, gradually replacing traditional passport stamps.

However, a record of crossing the external Schengen border does not necessarily establish presence in Spain on the UGE application date.

What documents should be kept?

  • Boarding passes and itinerary receipts.
  • Documents proving a crossing of the Schengen external border.
  • Confirmation of the trip directly to Spain.
  • Evidence of accommodation in Spain.
  • Additional official documents on the presence in the country, if necessary.

The specific set of evidence depends on the route, mode of entry and circumstances of the applicant.

AN IMPORTANT POINT

Why might an airline ticket be insufficient?

A ticket proves a booking or purchase of transport, while a boarding pass records a stage of the journey. These documents do not always establish conclusively that someone was physically present in Spain on a particular date.

Particular care is needed where someone entered through another Schengen country and then travelled to Spain on an intra-Schengen flight or by land.

What we consider is:
In some cases, a notarial record of the applicant’s personal presence in Spain may provide additional evidence. However, a notarised document does not replace lawful entry or guarantee that UGE will consider the evidence sufficient.

Proof of lawful presence is therefore a separate part of preparing the application, rather than a formality.

STEP BY STEP

How can you obtain a Spanish residence permit on a Schengen visa?

1

Check the visa and route

We assess visa validity, permitted days, travel history and lawful-presence conditions.

2

Check Digital Nomad eligibility

We assess contracts, remote work, income, qualifications and social security.

3

Prepare the documents

We collect certificates, income evidence, company documents, apostilles and sworn translations.

4

Document presence in Spain

We prepare evidence of the applicant’s lawful presence in Spain, taking account of their travel route.

5

Apply through UGE

We submit the electronic application and monitor its registration.

6

Assist during processing

We monitor notifications, respond to document requests and arrange the TIE card procedure after approval.

UGE PRACTICE

Why are additional documents requested and applications refused?

Holding a valid Schengen visa does not automatically mean that UGE will consider every circumstance of entry and presence established.

In considering the application, the following may raise questions:

  • Legality of stay at the date of application.
  • The applicant’s actual presence in Spain.
  • The route and the supporting documents.
  • Compliance with the stated and actual purpose of the visit.
  • Completeness of the Digital Nomad programme documents.

Important:
Assessing travel circumstances does not mean that Schengen-visa holders are automatically prohibited from applying. However, disputed circumstances should be analysed before applying, rather than after refusal.

PROCESSING DEADLINES

What if UGE doesn’t answer?

The relevant procedure provides a 20-day processing period. Apply the correct deadline-calculation rules and account for any lawful suspension.

Spanish law provides for positive administrative silence, silencio administrativo, but it should only be relied on after checking the procedural circumstances.

Additional requests, notifications and questions on the legality of the stay could have a significant impact on further action.

QUESTIONS AND ANSWERS

Frequently asked questions

Can you apply in Spain with a French or Italian Schengen visa?

A visa issued by another Schengen country does not itself rule out a Digital Nomad application. Its issue and use conditions must be respected, and lawful presence in Spain demonstrated.

Do you need a D visa first?

A national D visa is not a mandatory preliminary stage for a direct Digital Nomad application from Spain if the applicant is lawfully present and meets the programme requirements.

Can you apply immediately after entry?

The law does not impose a universal minimum number of days in Spain before applying. However, entry circumstances, document completeness and lawful presence require individual assessment.

Do you have to contact a notary?

A notarial record is not universally compulsory for every applicant. Whether it is needed depends on the entry circumstances and available evidence of presence.

Can a spouse and children obtain residence?

Yes, subject to the programme requirements, including proof of the relationship and sufficient resources.

What if UGE requests additional documents?

Assess the request, response deadline and documents needed to address the authority’s concerns. Do not ignore notifications.
